These General Terms and Conditions of Sale are entered into between:

Any person wishing to make a purchase via the seller’s website at https://lamoureuseparis.fr/
Hereinafter referred to as “the client” or “the buyer.”

Article 1: WEBSITE

1.1 The website lamoureuseparis.fr (hereinafter referred to as the “Website”) is an e-commerce site accessible via the Internet at www.lamoureuseparis.fr and is open to any user of this network.

1.2 The Website offers for sale a variety of clothing and accessories designed for women (hereinafter referred to as the “Product(s)”) to Internet users browsing the Website (hereinafter referred to as “User(s)”). For the purposes of these terms, it is agreed that the User and Lamoureuse shall collectively be referred to as the “Parties” and individually as the “Party,” and that a User who has validated an order will then be referred to as the “Buyer.” The rights and obligations of the User necessarily apply to the Buyer.

1.3 Lamoureuse reminds the Buyer that the Products are exclusively for personal use, with no direct connection to the Buyer’s professional activity. Lamoureuse reserves the right to refuse to fulfill any order.

1.4 The Buyer declares to have full legal capacity.

1.5 Any order for a Product offered on the Website implies the consultation and express acceptance of these General Terms and Conditions of Sale by ticking the box provided for this purpose before placing any order. As a reminder, in accordance with Articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree No. 2001-272 of March 30, 2001, relating to the electronic signature, the validation of the order form, as specified in Article 5.3 below, constitutes an electronic signature between the Parties with the same value as a handwritten signature.

1.6 The General Terms and Conditions of Sale aim to define the rights and obligations of the Parties arising from the online sale of Products offered on the Website.

Article 2: PRODUCTS

a) Product Description

2.1 The Products offered by Lamoureuse are those listed on the Website on the date of its consultation by the User and within the limits of available stocks.

2.2 The Products are described and presented as accurately as possible. Photographs illustrating the Products are not contractual. While Lamoureuse strives to represent the Products as faithfully as possible, variations in color may occur, especially due to technical limitations of color rendering on computer equipment.

b) Product Availability

2.3 Lamoureuse undertakes to honor orders received only within the limits of available stock. If one or more Products are unavailable, Lamoureuse will inform the User as soon as possible. Lamoureuse shall not be held liable for stock shortages or unavailability of Products.

2.4 Product unavailability may be notified to the User:

• During the order process, indicating that the desired product is temporarily unavailable.

• After order validation, via email sent to the Buyer by Lamoureuse.

2.5 If payment has already been made, Lamoureuse undertakes to contact the payment service to deduct the price of the unavailable Product(s) from the Buyer’s account.

c) Retention of Ownership

2.6 Products remain the property of Lamoureuse until full payment is received.

Article 3: PRICES

3.1 Prices indicated by the Seller at the time of the order are expressed in Euros, including VAT, based on the applicable VAT rate on the date of the order. Any rate change will be reflected without delay in the price of the offered Products.

3.2 The price charged to the Buyer is the price indicated on the order confirmation sent via email by Lamoureuse.

3.3 Lamoureuse reserves the right to modify its prices at any time and without notice. Products will be billed based on the rates in effect at the time the order is recorded, subject to product availability. The applicable rate is the one displayed on the Website, except for typographical errors for which Lamoureuse cannot be held responsible.

3.4 Prices must be paid in full in a single installment upon order validation.

3.5 Any unpaid amount will incur a flat fee of 25 euros per payment incident. Data recorded by the Website constitutes proof of transactions between Lamoureuse and the Buyer. Data recorded by the payment system constitutes proof of financial transactions. The sale becomes final after the transaction is accepted by secure payment services.

ALL ITEMS REMAIN THE EXCLUSIVE PROPERTY OF LAMOUREUSE UNTIL FULL PAYMENT IS RECEIVED, WHICH THE CLIENT ACKNOWLEDGES AND ACCEPTS.

Article 4: PAYMENT

4.1 Payments on the Website can be made via credit card or Klarna. Purchases can be securely paid 24/7 from France or abroad.

4.2 Users must enter their card number, expiration date, cardholder name, and the CVV code located on the back of the card.

4.3 Lamoureuse reserves the right to refuse any order from a User involved in any type of dispute.

4.4 Lamoureuse uses the secure payment service WooCommerce. Data integrity exchanged between the Buyer and the WooCommerce platform is protected against hacking attempts. Confidential data is directly encrypted and transmitted to WooCommerce servers without passing through Lamoureuse servers.

4.5 WooCommerce uses SSL (Secure Socket Layer) encryption and provides necessary assurances for online transactions.

4.6 Lamoureuse reserves the right to cancel any order that presents a risk of fraudulent card use.

Article 5: ORDER

a) Website Navigation

5.1 Users can freely browse the Website without being bound to an order.

b) Order Registration

5.2 To place an order, Users must click the “Add to Cart” button. Each new addition to the cart will be indicated with a specific screen.

5.3 Before order validation, Users can:

• View a summary of selected products and modify the order by clicking “Cart.”

• Continue shopping by clicking “Continue Shopping.”

• Complete the selection and validate the purchase by clicking “Checkout.”

5.4 To order selected products, Users must click “Checkout” and complete the guided purchase process.

5.5 An order summary will appear on the screen, showing the nature, quantity, and price of selected products, as well as the total order amount.

5.6 Users must fill out a form with accurate identification details, including first name, last name, email, password, birthdate, shipping address, and billing address.

5.7 Users are informed and accept that entering their credentials serves as proof of identity and consent.

c) Final Order Validation

5.8 Validation of the order by the User implies acceptance of the General Terms and Conditions of Sale.

5.9 Users will be prompted to complete payment by entering banking details.

d) Order Confirmation

5.10 After payment validation, a summary displaying the transaction number is provided. This summary is also emailed to confirm the order.

5.11 A shipping confirmation email, including a tracking link, is sent to the Buyer upon product dispatch.

Article 6: DELIVERY

a) Delivery Methods and Deadlines

6.1 Products are delivered worldwide to the address provided by the Buyer during the order process.

6.2 Orders are processed and shipped within 1 to 7 business days after they are placed. Once shipped, delivery times depend on the carrier’s schedule and the destination.

6.3 For deliveries within Europe, orders are shipped via Colissimo, and for deliveries to the United States, orders are shipped via UPS.

6.4 Shipping costs for orders to the United States are set at 35 euros, excluding any applicable taxes or customs duties. Buyers are responsible for settling any additional charges imposed by customs in their respective countries.

6.5 Lamoureuse strives to ensure delivery within a total of fifteen days from the date of order placement, excluding cases of force majeure as outlined in Article 9.

6.6 If the recipient is unavailable at the time of delivery, the package will be redirected to the nearest post office or delivery center, where it must be retrieved within the carrier’s specified timeframe.

6.7 Delivery addresses must be valid and complete. Lamoureuse does not deliver to P.O. boxes. Any delay or non-delivery caused by errors or omissions in the provided address is the responsibility of the Buyer.

6.8 Buyers can track their orders online using the tracking information provided in the shipping confirmation email.

Article 7: PRODUCT RETURNS AND RIGHT OF WITHDRAWAL

7.1 All sales are final. Lamoureuse does not currently offer options for returns or exchanges. If you have questions or concerns before making a purchase, please reach out to us at here.

7.2 Returns for items damaged during transit or within the first few days of use will be considered on a case-by-case basis. Please contact us via email at contact@lamoureuseparis.fr to report such issues.
